Allan D. Jergesen headed the firm's Health Care Section from 2002 until 2005. Allan has practiced in all areas of health law, with special emphasis on the following:
- hospital-physician organizations
- corporate, partnership, and joint venture issues
- licensing and certification questions
- reimbursement issues, including third-party payor agreements and PPO activities
- tax questions
- Medicare-Medicaid fraud and abuse issues
- hospital-physician relations, including medical staff matters, hospital-physician contracts and physician recruitment agreements
- patient care issues, including bioethics, health information (including electronic medical records), psychiatric law, and informed consent questions.
He serves as general counsel to the California Health Information Association. He is the author of the Allied Health Professional Manual, which serves as a legal guide for California hospitals in working with non-physician practitioners. Allan has served as an adjunct professor at the Golden Gate University program on hospital administration and is a member of the American Health Lawyers Association and the California Society for Healthcare Attorneys.
Allan also is actively involved in the senior housing and care field. He has provided advice and representation concerning the development of new retirement facilities, focusing on such matters as corporate formation, licensing issues, for-profit and nonprofit tax questions, and the creation of resident membership arrangements. In addition, he has given extensive advice concerning the legal aspects of day-to-day operations, including corporate issues, medical treatment questions, residents' rights, contractual disputes, and governmental relations. Allan frequently provides legal advice to the California Association of Homes and Services for the Aging and is a member of the Legal Section of the American Association of Homes and Services for the Aging.
Allan has presented seminars on the above subjects, written articles for legal, health, and retirement industry publications, and participated in the drafting of legislation and administrative regulations. He is rated AV by Martindale-Hubbell.
