Ray represents policyholders in complex insurance coverage disputes. Ray has obtained recoveries in excess of $100 million for a wide range of alleged liabilities and losses, including product liability/consumer class actions, data breach, patent and copyright infringement, trade secrets, antitrust injury, Fair Credit Reporting Act liability, pollution claims, securities fraud, employment discrimination, and commercial disputes. Ray has expertise in insurance for cyber liabilities and data breach.

Ray has advised clients on matters involving commercial general liability (CGL), errors and omissions (E&O), directors and officers (D&O), first- party property, cyberliability, fidelity/crime, employment practices liability (EPL), and pollution policies, as well as other forms of insurance. Ray has counseled clients in negotiating D&O programs and endorsements. He also has advised clients on insurance issues related to M&A and real estate transactions.

In addition, Ray has experience in litigating class actions and other complex commercial disputes.

Prior to joining Hanson Bridgett, Ray was a partner at Jones Day and a shareholder at Heller Ehrman LLP.

Representative Insurance Recovery Matters

Represented health & wellness company in securing coverage for defense and settlement of antitrust lawsuit. (E&O policies)

Represented consumer products manufacturer in obtaining coverage for defense and settlement of product liability lawsuits. (CGL, E&O policies)

Represented leading tech company in obtaining coverage for patent infringement lawsuit. (CGL policies)

Represented biotech company in securing coverage for lawsuit alleging disparagement and other business torts. (CGL, D&O policies)

Represented Merchant Services, Inc. in lawsuit regarding coverage for putative class action alleging misconduct in connection with the design, solicitation and implementation of credit and debit card processing services, as well as privacy claims. (E&O policies)

Represented Adobe Systems Inc. in litigation pursuing defense and indemnity for claims relating to editable font embedding in Acrobat® products, copyright, and end user license agreements. (CGL, excess and E&O policies)

Represented Sony Computer Entertainment America in seeking defense and indemnity for class action lawsuits alleging damages and defects in connection with the PlayStation® and PlayStation2® consoles. (CGL, excess/umbrella and E&O policies)

Represented TransUnion against London Market in litigation seeking coverage for nationwide class action alleging violations of the Fair Credit Reporting Act. (E&O policy)

Represented PG&E in insurance coverage lawsuit filed by AIG affiliates, which sought reimbursement of $24 million in payments made to settle property damage claims arising out of a wild land fire in Sonoma County, California. After a 7-week jury trial, the jury returned a verdict in PG&E's favor. (CGL and excess policies)

Representative Complex Litigation Matters

Represented PG&E in lawsuit seeking to compel California to allow PG&E to recover in excess of $9 billion in wholesale electricity costs incurred during the Western energy crisis of 2000-01.

Represented Behr Process Corporation (and its parent Masco) in putative nationwide and statewide class actions filed in eight states alleging that exterior wood coatings failed to retard mildew growth and ultraviolet light degradation. Also represented Behr in related insurance coverage litigation. (CGL and excess policies)

Represented Johns Manville Corporation in putative nationwide products liability class action.

Represented The Hertz Corporation in putative class actions challenging Hertz’s: (1) commission policies and disclosures for travel agents; and (2) fees and charges for car rentals.

Represented Telmatch Telecommunications in defense of “cramming” claims, and tried case before the California Public Utilities Commission.

Tried five criminal cases to verdict while on assignment to the San Francisco District Attorney’s Office.
