There are many issues to consider when negotiating a lease agreement with a communications company for the use of public property.  Because communications site lease agreements are generally long term leases, property owners should address the specific use of the property and the specific communications equipment that may be installed, the ability to relocate the facilities, the ability to adjust the rent to market rent, and the allocation of risk requiring the communications company to indemnify the property owner against liability arising from the use of the property.
