Developing Residence Agreements That Market Your Community (and Avoid Litigation)

Residence agreements play a vital role in the operation of any retirement community. They state the residents' and community's rights and obligations, they market the community's services to prospective residents, and they serve as an ongoing reference for both residents and administrators. Unfortunately, residence agreements too often are interminable treatises fraught with legalese and ambiguities. While a carefully drafted residence agreement will not salvage an ill-fated project, a poorly drafted agreement can endanger an otherwise viable project. To take an extreme example, a number of facility failures of the late 1970's were largely due to language in residence agreements that severely restricted facilities' ability to raise monthly fees in the face of double-digit inflation.
