Legislature Expands Elder Abuse Reporting Obligations

In the senior housing and care industry, elder abuse is the great equalizer. Whether the facility is for-profit or nonprofit, licensed or unlicensed, assisted living or nursing, government insured or private pay, well-run or not-so-well-run, it is vulnerable to lawsuits for elder abuse. Talk about elder abuse is pervasive these days. Because of the availability of enhanced monetary rewards, including attorneys' fees, many simple malpractice actions have metamorphosed into elder abuse claims. The availability of insurance for elder abuse claims has been cast into some doubt as a result of a poor understanding of the elder abuse statute, coupled with a State law prohibiting the provision of insurance for intentional conduct.
