Charging For Basic Services

A number of RCFEs have recently reported receiving deficiency citations from the Department of Social Services ("DSS") for the following policies or practices:

  1. Charging residents an additional amount for basic services that are not included in the monthly fee, such as transportation to medical appointments, provision of furniture, and provision of tray service during an illness;
  2. Continuing to impose the monthly fee for a specified period following the death of a resident;
  3. Failing to have a person in the facility at all times who satisfies all of the RCFE administrator regulatory requirements, including completion of an approved certification program. 

In each of these situations, DSS incorrectly issued deficiency citations. Unfortunately, in some instances, these citations have been upheld by both the licensing program supervisor and the district manager. CALFA has notified DSS Central Operations of these problems and will continue to monitor the situation and attempt to work with DSS to rectify them.
