Arbitration Clauses and Other Contract Protections

In response to the mouting level of litigation against seniors housing and long-term care operators, arbitration, mediation, jury trial lawyers and attorneys' fee clauses increasingly are being considered and used in resident admission agreements. Historically, the negative marketing effects that could accoompany the use of such provisions caused them to be used less frequently.
