Regulating Motorized Cart Use

Retirement housing operators are increasingly becoming concerned about the operation by residents of motorized carts in and around the property. Carts are motor vehicles that can cause personal injury to others or property damage to the community. Managers often seek to regulate the use of such carts in an effort to minimize the risk of personal injury or property damage, but in doing so, they must be mindful of the rights of disabled residents under the federal Fair Housing Act.
