Legal Update: Common Wage and Hour Mistakes

Wage and hour audits by the California Labor Commissioner, as well as individual employee complaints filed with the Labor Commissioner, are on the rise in the long-term care industry. Providers facing these audits or responding to employee complaints often are surprised to learn that their wage and hour practices are not compliant with California· law. Both the California Labor Code and Wage Order 5, which applies to employers in the health care industry, contain complicated and detailed requirements about when, how and how much employees must be compensated. To avoid significant back pay liability and costly penalties, providers must be sure to fully comply with their Labor Code and Wage Order 5 obligations.
