California’s Proposition 37 would Require Strict GMO Food Labeling

California voters will decide this November whether to adopt Proposition 37, also known as “The California Right to Know Genetically Engineered Food Act.” If approved, Proposition 37 would be the first law of its kind in the nation to require food producers and sellers to label genetically engineered foods. The proposed law would redefine the “natural” food category in California and perhaps nationwide with regard to the labeling of genetically engineered products and arguably any other processed food products, whether or not genetically engineered. Proposition 37 would also establish a private right of action for consumers to sue for enforcement and facilitate these suits by eliminating two elements typically required in misbranding cases, reliance and damages.
