Expanded Avenues for Plaintiffs Claims under ERISA

The Supreme Court recently expanded the legal avenues that individuals can pursue when the value of their 401(k) or other defined contribution plan accounts drop. In LaRue v. DeWolff, Boberg & Associates, the Supreme Court held that an individual participant may be able to recover monies when an ERISA fiduciary’s breach of duty affects the value of the individual’s account.
