Land Use Alert: California Supreme Court Decides 30 Day Statute Of Limitations Applies To Determination That No Environmental Review Is Required Under CEQA

In an important case dealing with the statute of limitations for challenging California Environmental Quality Act (CEQA) determinations, the California Supreme Court has ruled that when a governmental entity issues a Notice of Determination under CEQA and an action alleges that no environmental review was undertaken for an aspect of the project, the appropriate limitations period is 30 days and not the longer 180 day period specified for when no determination is made by the agency.
