Water Law Alert: California Court of Appeal Reaffirms Traditional Common Law Formula For Determining Boundary Lines Between Littoral Land Owners

Rejecting arguments that a disputed boundary for littoral rights requires explicit equitable balancing and an exacting determination of the shoreline’s historical contours, the First Appellate District Court of Appeal reinforced common law techniques for resolving littoral boundaries in summary adjudication with its January 29, 2010 opinion in Kendall v. Walker, No. A105981.
