Governor Newsom Issues Orders to Assist with Rebuilding Efforts in Los Angeles; Los Angeles County Bans the Removal of Fire Debris

Governor Newsom Has Suspended Several Environmental Laws, Coastal Regulations, and Local Ordinances to Assist in Rebuilding Efforts:

  • The California Environmental Quality Act (CEQA) and California Coastal Act requirements for projects repairing, restoring, demolishing, or replacing properties substantially damaged or destroyed by the fires are suspended. This suspension applies to properties rebuilt in the same location, not exceeding 110% of their original footprint and height, as well as projects that include the construction of a new accessory dwelling unit that did not previously exist.
  • Ordinances adopted by local governments within Los Angeles County that preclude the placement and use of a manufactured home, mobilehome, or recreational vehicle on a private lot (outside of mobilehome parks and special occupancy parks) for use during the reconstruction or repair of any home damaged or destroyed by the fires are suspended.
  • Ordinances prohibiting issuance of a certificate of occupancy for an accessory dwelling unit before the certificate of occupancy for the primary dwelling on any residential property substantially damaged or destroyed as a result of the fires are suspended.
  • Ordinances which preclude the placement and use of a manufactured home, mobilehome, or recreational vehicle on a private lot (outside of mobilehome parks and special occupancy parks) for use during the reconstruction or repair of any home damaged or destroyed by the fires are suspended.

Governor Newsom Extended Price Gouging Protections:

Laws prohibiting price gouging in hotel or motel rates and rental housing and eviction of a residential tenant and re-letting the unit at a higher price in times of emergency remain in effect until March 8, 2025, for Los Angeles County.

Los Angeles County Instituted a Ban on the Removal of Fire Debris:

Fire debris cannot be removed without a hazardous materials inspection conducted either by the U.S. Environmental Protection Agency or California Department of Toxic Substances Control or the Los Angeles County Fire Department’s Unified Program Agency, or other participating local government Certified Unified Program Agency. The ban does not apply to the removal of personal property from residential sites. Inspections are required because the combustion of building materials can produce hazardous substances that can cause health problems.
