Merton Howard Moderating Session at 2025 DRI Product Liability Conference

The panel will discuss changes, trends, and challenges in the areas of consumer product regulation, enforcement, and litigation with the CPSC, and what that means for manufacturers, distributors, retailers, and marketplaces. In particular, we will focus on the impact of the SCOTUS decision striking down Chevron deference in Loper Bright Enterprises v Raimondo, the recent ALJ ruling in the Leachco matter holding that CPSC Complaint Counsel did not prove by a preponderance of the evidence that the product at issue presents a substantial product hazard as defined by the Consumer Product Safety Act (CPSA) and that a recall is therefore warranted, the impact of the 2024 election, the influence of global product safety regulations and standards, recent recalls and unilateral agency action, and other issues important to industry.
