A federal district court in Texas has issued a nationwide permanent injunction, blocking the Department of Labor’s implementation of its union persuader rule.
As we previously reported, the “persuader” rule requires employers and their advisors to disclose their relationship for any advice that “indirectly persuades” employees regarding union organizing or collective bargaining. The court concluded that such a rule is unlawful, converting the
preliminary injunction it issued in June 2016 into a permanent injunction with nationwide effect. The court’s preliminary injunction order is currently on appeal before the Fifth Circuit.
